      Signatures   03/04/2016

Hi everyone. It appears that the update to the new forum has affected the format of the majority of signatures (adding extra spaces, changing sizes etc.). Due to this, could everyone please check their own signature, ensuring that it complies with the site rules. See the http://www.emergency-planet.com/tos.html/ or http://www.emergency-planet.com/topic/16848-acceptable-signature-sizes/ for more information.  We'll give it a few weeks to give enough time to edit signatures, after that the unnecessarily large signatures will simply be removed. Thanks for your cooperation. Regards, EMP Staff.

UPDATED TERMS OF SERVICE! Please Read!

Recommended Posts

The Terms of Service (TOS) have been updated today, please re-read them so you are aware of subsequent changes that have occured:  The altererations are noted below as well as a link to the services in-full.

15. Multiplayer Associations and/or Clans
Emergency-Planet forum support permits associations and clans to maintain a single topic within the multiplayer sections of our forum if the following terms and conditions are adhered to by the organization administrators and any subsequent user within their organization.
A.Topic Updates - Organization members and/or administrators are permitted to update their topic within reason. Meaning that if a post is created advertising the clan and approximately 2 weeks time has passed, they may re-promote their site at that time. Unnecessary "bumping" of the topic will lead to penalties including warnings for the administrator as well as the offending member of their organization that offended, up to permanent removal of the privileges to advertise their clan on Emergency-Planet.
B.Responsibility for members of the guest organization - The "Administrator" (chair, chief, leader, etc) of the guest organization that wishes to promote on Emergency-Planet is responsible for ALL staff, members, deputies (all persons underneath their organization) conduct on the Emergency-Planet sites and it's forums. Any infractions on Emergency-Planet committed by any member of the guest organization may result in the person in charge of the guest organization being held liable for their member's actions. Any punishment issued to one of the members of the guest organization may be applied to the leader of said guest organization as well. You as the leader of your organization are accountable for your actions, as well as any taken by any of your organization. Bear this in mind when permitting your members to make statements representing your organization.
C.Emergency-Planet Responsibility for outside content related to outside organizations - Emergency-Planet and its sites and forums are not liable for the content published by any outside organization, we are not liable for any organization's websites/teamspeak servers/or any other form of communication device they opt to use. Any issues pertaining to any outside organization should be pursued within that organization or with their hosts. We at Emergency-Planet DO NOT have any obligations in addressing matters related to outside organizations that have not taken place on our site. Do not expect us to deal with any issues that occur outside of our services, doing so will result in punishments including warnings, suspensions, and potentially revoked privileges for your organization within our site.
D.External issues brought to Emergency Planet between other organizations - If an issue should occur between outside organizations they will NOT be tolerated on Emergency-Planet sites or forums. Any issues brought to our services pertaining to outside issues from persons who do not have anything to do with our sites or services will result in immediate revoked privileges to use our services to advertise your organization, along with punishments for the leader of the organization and any members that are involved in offenses.

I don't know if it matters legally but the possessive form of 'its' remains its, not it's.

Not really, no it does not matter.  The intent of the terms and conditions remains the same.  Such is what happens when you are doing something distracted.

The addition of terms is merely to advise people of things that we have ran into recently that now have an official term and condition associated with them, the full terms of services actually covers any actions we may need to take.  This was more or less added to give people a stated guideline in regards to this particular aspect of the site.

Thanks for pointing that out though.

So folks, just to make a few things clear:

Whomever makes the topic promoting the clan, be it the leader, or a staff member, or whatever, you're now on the block for any and all warnings that stem from this clan. That's the biggest change we're bringing in. If you as the clan leader ban someone for whatever reason, and they come storming over here creating problems, you're probably gonna get a warning for that. Why? Because you created problems over here. Not every case will result in penalties against the clan leader, but many will, since it becomes a he said she said game, and more work for us.

Also, remember this, EmP does not deal with outside issues, whatsoever. That's a big thing that brought down this change. People fighting in clans, spilling over here, and expecting us to do something. If XYZ clan offends you, deal with XYZ clan. You post crap here, we'll warn you for it. That simple.

This is a pretty simple rule set to follow, and makes life a lot easier for everyone. Afterall, no one likes reading clan drama anyways.

Also, just to reitterate, if you're a problem clan, you'll be banned from the site, period. That's been past practice, now it's a written rule.

Oh! I thought this was one of those legal things.

Sorry!

The terms of service are legally binding, however, unlike what most people want to believe, when it comes to terms and conditions, as long as the intentions of the document are established and you can understand them clearly there isnt much need to overcomplicate the document.  The only time that really comes into play is in legal--as in defensive arguements, if someone were to try to raise a doubt in the document for such a minor error, no judge in their right mind would go "oh well this changes everything! the document is flawed, throw it completely out the window!"  They would be quite angered at the person arguing that minor point for wasting the court's time.

The reality is under other clauses of the terms of services, we have established everything legally for this site, by using the service you agree to those terms which as an umbrella cover anything that we should pursue at our discretion.  In the interest of fairness, that is why this section was created and clearly marked for what it covers, and how we will pursue it.  In the end legally there is no way around the rules or their enforcement with or without the additional section, it was added mostly for the users to be clearly advised of the alterations which we will pursue if need be.

People assume website services to be a RIGHT, they don't understand that the ability to access, post, download, etc from a site is in fact a privilege, in which no government of the world may deem an entity MUST provide that service to ALL users.  If it were in our best interests, we reserve the right to terminate the availability to users at any given time, that could include an entire nation for example if they were disruptive to our operations.  If people realized that the internet was a different beast than what most people follow in legal proceedings, they'd do alot better in bringing up their legal arguments that in most instances are frankly inapplicable.
